These Terms & Conditions ("Terms") govern your use of Scrumling ("Service"), a website and online course operated by Sima Tech Ltd (Сима Тек ООД), UIC 206762842, VAT BG206762842, registered in Pernik, Bulgaria ("we", "us"). By accessing or using the Service, you agree to these Terms.
1. Who can use Scrumling
You must be at least 16 years old to create an account. By registering, you confirm the information you provide is accurate and that you will keep your credentials confidential.
2. The Service
Scrumling is a gamified educational service about Scrum and Agile ways of working. Access to lessons, games, quizzes, and completion certificates is currently offered free of charge. We may add paid features in the future; any such features will be clearly marked before purchase.
Scrumling is not affiliated with, endorsed by, or a substitute for Scrum.org, Scrum Alliance, Scaled Agile, Inc., or the authors of the Scrum Guide. Certificates we issue are Scrumling certificates only and do not confer any external professional certification.
3. Your account
- You are responsible for activity under your account.
- You may not share, sell, or transfer your account.
- We may suspend or close accounts that abuse the Service, attempt to circumvent access controls, or violate applicable law.
4. Acceptable use
You agree not to:
- Scrape, resell, or republish course content without written permission.
- Reverse-engineer or interfere with the Service's security.
- Upload content that is illegal, infringing, or harmful.
- Use the Service to spam, harass, or impersonate others.
5. Intellectual property
All course content, code, design, and branding on Scrumling are owned by Sima Tech Ltd or its licensors and are protected by copyright and trademark law. You receive a personal, non-transferable, revocable licence to use the content for your own learning. "Scrum" and related marks are the property of their respective owners.
6. Data processing
Sima Tech Ltd processes your personal data as described in our Privacy Policy. In summary:
- We collect account data (email, display name, auth identifiers), learning data (lesson completions, quiz scores, language preference), and technical data (IP address, device/browser info, sign-in timestamps) to run the Service, keep it secure, and improve it.
- We use the subprocessors listed in the Privacy Policy — currently Lovable (build / deployment / hosting / error reporting), Supabase (auth / database / storage in the EU), Cloudflare (edge network / security), and Google Ireland Ltd. (optional Google sign-in). We do not use third-party analytics, advertising, marketing-automation, session-replay or A/B-testing tools, and we do not sell personal data.
- When you delete your account, your account, progress and quiz records are removed from the live database immediately and purged from encrypted backups within 30 days. Authentication and sign-in logs are kept for up to 90 days; edge / hosting security logs for up to 30 days; platform error reports for up to 90 days. The Service is currently free, so no invoicing / accounting records are created.
The Privacy Policy is incorporated into these Terms by reference. If you have questions about your data, contact privacy@simatech.bg.
7. Consumer rights (EU / EEA)
Where the free Service is provided without payment, EU consumer withdrawal rights do not apply. If we introduce paid digital content, you will be informed of your 14-day right of withdrawal under Directive 2011/83/EU and any lawful limitations before purchase.
8. Disclaimer
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we exclude all implied warranties. Course content is educational and does not constitute professional advice for any specific project or organisation.
9. Limitation of liability
Nothing in these Terms limits liability that cannot be limited by law (e.g., death or personal injury caused by negligence, or fraud). Subject to that, our aggregate liability arising out of or in connection with the Service is limited to EUR 100, or the amount you paid us in the 12 months before the claim, whichever is greater.
10. Termination
You may delete your account at any time from your account settings or by writing to privacy@simatech.bg. We may terminate or suspend access if you materially breach these Terms.
11. Governing law and disputes
These Terms are governed by the laws of the Republic of Bulgaria, without regard to its conflict-of-laws rules. EU consumers retain the protection of mandatory provisions of the law of their country of residence. Disputes fall under the exclusive jurisdiction of the competent courts in Sofia, Bulgaria, subject to any mandatory consumer forum rights. EU consumers may also use the European Commission's Online Dispute Resolution platform.
12. Changes
We may update these Terms. Material changes take effect 30 days after publication on this page and are notified to registered users by email where practicable.
